By accessing or using our website, mobile app, or any related services (collectively referred to as “the Platform”), you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before using the service.
1. Introduction
SmartlyCare is a digital platform that connects families with verified caregivers for children, seniors, pets, and home assistance services.
The Platform acts solely as an intermediary between clients and caregivers and does not directly provide or supervise caregiving services.
2. Definitions
- Platform: refers to SmartlyCare, including its website, mobile app, and related services.
- User: refers to any individual or organization using SmartlyCare, including both Clients and Caregivers.
- Client: means any person or family seeking caregiving services.
- Caregiver: means any individual or organization offering caregiving or home-related services through SmartlyCare.
- Services: means any caregiving or related activity arranged via SmartlyCare.
3. Eligibility and Account Registration
- Users must be at least 18 years old to create an account.
- You agree to provide accurate, complete, and current information during registration and to keep it updated.
- You are responsible for maintaining the confidentiality of your account and password.
- SmartlyCare reserves the right to suspend or terminate any account that violates these Terms.
4. Use of the Platform
- Users agree to use SmartlyCare only for lawful purposes and in accordance with these Terms.
- Clients and Caregivers are solely responsible for the accuracy of the information they provide.
- Directly contacting a Caregiver or Client outside the Platform to avoid fees or bypass SmartlyCare’s system is strictly prohibited.
5. Platform Role and Responsibility
- SmartlyCare facilitates connections but is not a party to any agreement between Clients and Caregivers.
- SmartlyCare does not guarantee the quality, timing, legality, or safety of services provided by Caregivers.
- The Platform may conduct background checks, but final responsibility for evaluating Caregivers rests with the Client.
6. Payments and Fees
- All payments must be made through SmartlyCare’s secure payment system.
- SmartlyCare may charge a service fee or commission, which will be displayed before confirming a booking.
- Refunds or cancellations are governed by our Cancellation Policy (see below).
7. Cancellations and Refunds
- Clients may cancel a booking within the allowed timeframe stated during booking.
- Late cancellations may result in partial or full payment charges.
- SmartlyCare reserves the right to mediate disputes but does not guarantee resolution outcomes.
8. User Responsibilities
- Treat all users respectfully and professionally.
- Provide honest feedback and accurate information.
- Do not engage in harassment, discrimination, or illegal activities through the Platform.
- Report any suspicious or inappropriate behavior to SmartlyCare support immediately.
9. Privacy
Your privacy is important to us.
Please refer to our separate Privacy Policy for details on how we collect, use, and protect your personal information.
10. Intellectual Property
All content, logos, designs, and trademarks on the Platform are the exclusive property of SmartlyCare and may not be used without prior written consent.
11. Limitation of Liability
SmartlyCare is not liable for:
- Any direct, indirect, or consequential damages resulting from the use or inability to use the Platform.
- The actions, errors, or omissions of any Caregiver or Client.
- The Platform is provided “as is” without any warranties.
12. Termination
SmartlyCare may suspend or terminate your access to the Platform at any time if:
- You violate these Terms;
- Fraudulent or harmful activity is detected;
- Required by law or regulation.
13. Modifications to Terms
SmartlyCare may revise these Terms from time to time. Any updates will be posted on this page with a new "Last Updated" date. Continued use of the Platform means you accept the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Islamic Republic of Iran (or the relevant jurisdiction where SmartlyCare operates). Any disputes will be resolved through competent courts in Tehran, unless otherwise specified.
